With a verbal, telephone or written (also email) accommodation reservation you have concluded a legally valid rental agreement with us as your host. The provisions of the fixed-term rental agreement from the German Civil Code (BGB) and additionally the general conditions of the German Hotel and Restaurant Association (DEHOGA) apply.
The guest accommodation contract is concluded as soon as the accommodation has been ordered and confirmed.
The conclusion of the guest accommodation contract obliges both parties to fulfill the contract and cannot be dissolved unilaterally, i.e. without the consent of the other contracting party.
The landlord is obliged to pay compensation to the guest if the accommodation is not provided.
If the tenant withdraws from the rental after the rental agreement has been concluded, the guest is obliged to pay the agreed price if the contractual services are not used, less the expenses saved by the landlord: the savings amount to 10% in accordance with the International Hotel Regulations for vacation apartments.
The landlord is obliged in good faith to rent out unused accommodation to another party if possible; however, the guest is liable in accordance with point 1.5 until the accommodation is rented out to another party.
The guest will be informed immediately of his obligation to bear any cancellation costs; the guest will only be invoiced for the costs after the expiry of the canceled booking period.
The tenancy includes the vacation apartment with all accessories as described in our offer letter. All vacation apartments are fully furnished. Cutlery, crockery, pots and pans, linen (bed linen, tablecloth, small towels & bath towels and kitchen towels) are provided. Additional linen is available from the office at Trettachstraße 17 for a fee. All electronic devices and equipment are checked before the tenant arrives. In the event of faults and breakdowns, the landlord will endeavor to rectify the damage as quickly as possible. Der Mieter ist nicht berechtigt, die Miete zu kürzen. The landlord is not liable for the snow clearing and gritting obligations of the respective property managers.
All vacation apartments may only be occupied by the agreed number of tenants. Arrival may take place from 16.00 hrs, departure must take place by 10.00 hrs. If you arrive before 4 p.m., there is no guarantee that the apartment has already been cleaned.
The tenant must treat the vacation apartment and the inventory contained therein with care. The tenant must clean the apartment regularly and leave it in a clean condition before departure. In particular, the bathroom and the kitchen, the stove, the refrigerator and the dishes must be left in perfect condition, otherwise a cleaning surcharge of 30 euros will be charged. The vacation apartment may be entered by a representative of Huth GmbH at any time during business hours for the purpose of rectifying any defects. Damage of any kind to the vacation apartment or its contents must be reported immediately to the agency by the tenant and repaired or replaced.
The scope of services included in the inclusive price is described in the rental list. No reimbursement can be made for services not used.
The tenant must check the inventory of the vacation apartment carefully at the start of the rental period and report any complaints to our office within 1 working day. This ensures that only the previous tenant can be held liable for any damage or missing items if they have not been reported or replaced.
The place of jurisdiction is the place of business.
Terms of payment: Receipt of payment of the invoice amount, at the latest 14 days before arrival. After receipt of payment, the key will be sent to you by post.
We strongly recommend that our guests take out travel cancellation insurance.
Guests can use DSL Internet access via WLAN in some apartments (where indicated). This is a voluntary additional service, i.e. not a guaranteed feature of the vacation apartment under travel law.
Accordingly, a reduction in rent cannot be claimed if the system or parts thereof or even a router fails.
